saya share ni sbb ade yg bertanyakan berkenaan ape sebenarnya yg lawyer patut uruskan bile kite hire diorang ni utk urusan jual beli rumah…list dibawah ni mungkin ade kurang atau lebih…tapi hopefully boleh la dijadikan sebagai info asas

Basic functions of a lawyer in property transaction are as following:

  • Prepare draft of Sales and Purchase Agreement
  • Provide explanation on the Sales and Purchase Agreement to the purchaser
  • Documents stamping
  • Make payment of stamp duty on behalf of purchaser
  • Register and submit necessary documents to the relevant land office
  • Liaise with developer/vendor and with bank
  • Act as mediator between developer/vendor, purchaser and bank
  • Forward documents to the purchaser
  • Notify purchaser and/or bank of any payment which need to be made
  • Accept payment on behalf
  • Forward documents to purchase and forward the title in the name of the purchaser in the end of the transaction

of course there are some other functions depends on the type of properties as some properties will required additional documents or registration during the transaction…however the above list are the basic functions that at least you should know when hiring a lawyer…takde la nanti mcm malu2 nak suruh lawyer buat itu ini…dh memang part of their services

    Saya nak tanya, kalau kita nak beli rumah dari tangan orang, duit lawyer sapa nak kena bayar? saya atau penjual rumah tersebut?

    Man, buyer kena byr utk urusan2 seperti dlm post di atas…penjual pun kena hire lawyer juga utk dia punya part…yg tu penjual la kena byr

    mana nk ngadu jika ada lawyer2 nih xtak buat keje yg dia patut buat ie submit doc to land office,tukar nama dll.sy ada experience dgn lawyer yg loyar buruk ni…sakit hati rasa…dh minta byran mahal tp keja buat cincai jer

    Sometimes, kena ‘limit’ processing period dgn lawyer, cth: 3 month dlm agreement, else refund deposit balik kt purchaser, sbb ada kes penjual sangkut kat cukai tanah, etc, lalu tergendala sekejap proses pembelian – which lawyer suppose to anticipate isu2 berkaitan before proceed for deposit acceptance dari purchaser. Nih dari pengalaman dua kali beli rumah, elok duit refund deposit tu kita masuk ASB/UT sendiri sementara tunggu penjual setel masalah propoerty, kalu tak, lawyer yang untung dpt ‘park’ duit deposit purchaser kat akaun UT sendiri sementara tunggu penjual setel urusan cukai tanah, etc (cuma andaian semata2 :) )
